DOVER, Del. (AP)- A bill asserting that county sheriffs and their deputies in Delaware do not have arrest powers is headed for a vote in the state House.
The bill was released Wednesday from a committee chaired by its chief sponsor, Democratic Majority Leader Pete Schwartzkopf. Schwartzkopf introduced the bill last week after Republican Rep. Daniel Short tabled a similar bill he had introduced earlier in favor of a resolution asking the state Supreme Court for an opinion on the issue.
Committee members voted Wednesday not to release Short's resolution.
Meanwhile, Sussex County Sheriff Jeff Christopher, whose actions have prompted efforts to clarify the powers of sheriffs, sued the county Wednesday, asking a judge to declare that he is the county's chief law enforcement officer and has police powers under the state constitution
