WILMINGTON, Del. (AP)- A Delaware man who had his family's basketball hoop removed by state officials for being too close to the road is suing.
John McCafferty is suing the Delaware's Department of Transportation. McCafferty says his family's basketball hoop was wrongly taken by officials in 2011. He says a law that prohibits trees and other objects within 7 feet of the pavement's edge in a residential neighborhood is unconstitutional.
The McCafferty family didn't let the hoop go without a fight. Last year McCafferty's wife parked her van underneath the hoop and then sat on it to prevent officials from confiscating it. She later backed down when authorities threatened to arrest her and take her car.
