New Charges Filed in O.C. Crash That Left Mother, Baby Injured

SNOW Hill, Md.- The Worcester County State's Attorney's Office on Friday announced that new charges have been filed against the driver accused of causing a December car crash in Ocean City that injured Ann Marie DelRicco and her 18-month-old daughter Ava.
According to the State's Attorney's Office, the following charges were filed in the Worcester County Circuit Court against 47-year-old Andre James Kaczynski:
  1. Life-threatening injury by motor vehicle while impaired by a controlled dangerous substance (Victim: Ava DelRicco)
  2. Life-threatening injury by motor vehicle while impaired by a controlled dangerous substance (Victim: Ann Marie DelRicco)
  3. Possession of phencyclidine (PCP)
  4. Driving while impaired by a controlled dangerous substance
  5. Aggressive driving
  6. Reckless driving
  7. Negligent driving
  8. Failing to control speed to avoid collision
  9. Speeding
  10. Possession of phencyclidine (PCP)
  11. Possession of marijuana
Authorities said that Kaczynski was under the influence of drugs on Dec. 16 when he slammed his pickup truck into the back of the car driven by Ava's mother, which was stopped at a red light on 142nd Street in Ocean City. Both Ava and her mother are recovering from life-threatening injuries sustained in the crash.
Prosecutors said that counts 1 through 9 relate to the Dec. 16 crash that left the mother and daughter injured, as well as the seizure of PCP from Kaczynski's motor vehicle. Counts 10 and 11 relate to a search and seizure warrant that was executed on Dec. 22 at Kaczynski's home in Ocean Pines, which according to prosecutors, resulted in the seizure of PCP and marijuana.
Kaczynski was originally charged for the Dec. 16 incident in the District Court of Maryland and held on a $100,000 bond.  Kaczynski posted that bond three days later.  
Kaczynski was also charged in the District Court of Maryland for the Dec. 22 incident. He appeared before a Worcester County District Court commissioner who ordered him held without bond following the presentation of evidence by prosecutors.
Prosecutors noted that Kaczynski was held without bond over the Christmas holiday, but was ultimately granted a $25,000 bond after being brought before a District Court judge on Dec. 27.
Friday's Circuit Court filing includes several additional charges, including a count alleging that Kaczynski caused life-threatening injuries to Ann Marie DelRicco by motor vehicle while impaired by a controlled dangerous substance. 
Prosecutors also noted that as a result of Friday's action, the two District Court cases will be forwarded to the Circuit Court and will be consolidated for trial on a date that has yet to be set.
Worcester County State's Attorney Beau Oglesby said in a statement that "the Circuit Court was clearly the more appropriate venue for this trial based on the seriousness of this case
